Welcome to the real estate platform of Blue Desert Cabo (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our real estate services, including our website, MLS search tools, and brokerage consultations. By accessing our services, you agree to be bound by these Terms and the laws of Baja California Sur, Mexico.
1. SCOPE OF SERVICES
Blue Desert Real Estate provides a platform for browsing luxury property listings, connecting with licensed real estate advisors, and accessing Multiple Listing Service (MLS) data in the Los Cabos region. We act as a brokerage and marketing entity; we do not own the properties listed unless explicitly stated.
2. ACCURACY OF LISTING DATA
Source of Information: Information regarding featured properties is provided by the listing agent, the seller, or through various Multiple Listing Services (MLS).
“As Is” Basis: While we strive for accuracy, Blue Desert Real Estate does not guarantee the accuracy of square footage, lot size, boundary lines, or property condition. All information should be independently verified through a formal “Due Diligence” period during a transaction.
Availability: All listings are subject to prior sale, change, or withdrawal without notice.
3. INTELLECTUAL PROPERTY & CONTENT
Ownership: All website content, including logos, text, and custom photography owned by Blue Desert, is protected by copyright.
Limited License: You are granted a limited license to print or download listing information for personal, non-commercial use only.
Prohibited Use: Scraping, “framing,” or unauthorized redistribution of our listing data or photography for use on competing real estate platforms is strictly prohibited.
4. AGENCY RELATIONSHIPS
Brokerage Disclosure: Accessing this website does not create a fiduciary or “Broker-Client” relationship. Such a relationship is only established once a formal Listing Agreement or Buyer’s Representative Agreement is signed by both parties.
Dual Agency: Blue Desert Real Estate may represent both buyers and sellers in the same transaction. In such cases, we adhere to strict transparency and Mexican AMPI (Asociación Mexicana de Profesionales Inmobiliarios) ethical standards.
5. MEXICAN REAL ESTATE COMPLIANCE
Foreign Ownership: Users acknowledge that real estate transactions in the “Restricted Zone” (within 50km of the coast) for non-Mexican citizens must be held through a Fideicomiso (Bank Trust) or a Mexican Corporation.
Notary Public: In accordance with Mexican law, all formal real estate transfers must be ratified before a Mexican Notario Público.
Currency: While prices may be displayed in USD for convenience, the legal currency for transactions within Mexico is the Mexican Peso (MXN) unless otherwise agreed upon in the promissory contract, calculated at the exchange rate published by the Bank of Mexico on the date of payment.
6. PRIVACY & DATA COLLECTION
By using our MLS search or inquiry forms, you agree to our Privacy Policy. We collect information to:
Provide property updates and market reports.
Facilitate connections between buyers and sellers.
Share data with trusted partners (Notaries, Escrow companies, Closing Attorneys) necessary to complete a transaction.
7. LIMITATION OF LIABILITY
Blue Desert Real Estate, its partners, and agents shall not be liable for any direct or indirect damages resulting from:
Errors or omissions in listing information.
The conduct of third-party service providers (Home inspectors, attorneys, lenders).
Fluctuations in the Los Cabos real estate market.
8. DISPUTE RESOLUTION & GOVERNING LAW
Any dispute arising from the use of this site or our real estate services shall be governed by the laws of the State of Baja California Sur, Mexico. You agree to submit to the exclusive jurisdiction of the courts located in Cabo San Lucas or San José del Cabo.
